Mr. Saffer advises clients on the full range of intellectual property-related issues faced by large and small businesses. Mr. Saffer is a co-chair of Townsend's nationwide litigation group and his practice includes all areas of intellectual property litigation, including patent, trademark, copyright, technology license, and trade secret cases. He has first-chaired more than a dozen trials and regularly appears in federal and state courts and in various alternative dispute resolution forums. Mr. Saffer also handles worldwide trademark and copyright acquisition, clearance, registration, and licensing matters, including domain name and other Internet-related matters. Mr. Saffer advises clients in a variety of industries and technologies, including media and entertainment, telecommunications, electronics, manufacturing, software, medical devices, resorts, real estate development, and financial services.
Representative Matters
- Broadcast Music, Inc. et al. v. various defendants. Successfully represented recording artists, publishing companies, and performance rights society in a series of copyright enforcement actions to enjoin the authorized public performance of musical works.
- Toshiba Corp. v. Hynix Semiconductor, Inc. Represented patentee in assertion of patent covering integrated circuit design methods; obtained favorable claim construction, which allowed parties to amicably resolve the litigation.
- Wizard Art Glass, Inc. v. Brass Smith, Inc. Obtained summary judgment of infringement against direct competitor for owner of mechanical device patent.
- JingJing Genetic, Inc. v. XY, Inc. Successfully defended preliminary injunction motion in breach of biotechnology license agreement.
- Josh Agle, Inc. v. Fusion Entertainment. Obtained trial court order dismissing trademark and copyright infringement claims with respect to alleged use of works of visual art and artist's name.
- Stormwater Management, Inc. v. CDS Technologies, Inc. Obtained favorable claim construction of water filtration patent for infringement defendant, which led to a favorable out-of-court resolution.
- Mr. Saffer advises on the management of worldwide trademark portfolios for several media content and distribution clients, as well as for a number of Colorado's most famous ski and snowboard resorts.
